Refund and Cancellation Policy

This Refund and Cancellation Policy outlines the terms and conditions for refunds and cancellations for Artha ERP Service ("Service") provided by Adwaita Techno Labs ("Company", "we", "our", or "us"). Please read this policy carefully before subscribing to our Service.

Important Note: As a Software-as-a-Service (SaaS) platform, Artha ERP operates on a subscription model. Due to the nature of our Service and the immediate access granted upon subscription, refunds are generally not provided except in specific circumstances outlined in this policy.

1. General Refund Policy

Artha ERP subscription fees are non-refundable except as specifically stated in this policy. Once you subscribe to a plan and gain access to the Service, we consider the service as delivered. This policy applies to:

  • Monthly subscription plans
  • Annual subscription plans
  • Custom development services (subject to separate agreements)

2. Cancellation Policy

2.1 How to Cancel

You may cancel your subscription at any time through your account settings or by contacting our customer support team at support@arthaapp.in.

2.2 Effect of Cancellation

When you cancel your subscription:

  • Your cancellation will take effect at the end of your current billing period
  • You will retain access to the Service until the end of the paid period
  • You will not be charged for subsequent billing periods
  • No refund will be provided for the remaining days of your current subscription period
  • Your account and data will be accessible during the remaining subscription period

2.3 Data Access After Cancellation

After your subscription ends, you will have a grace period of 30 days to export your data. After this period, your account and all associated data may be permanently deleted in accordance with our data retention policy.

3. Exceptional Circumstances for Refunds

While refunds are generally not provided, we may consider refund requests on a case-by-case basis in the following exceptional circumstances:

3.1 Technical Issues

If you experience significant technical issues that prevent you from using the Service, and we are unable to resolve these issues within a reasonable timeframe (typically 7-10 business days), you may be eligible for a partial or full refund at our discretion.

3.2 Duplicate Charges

If you are accidentally charged multiple times for the same subscription period, we will refund the duplicate charge(s) promptly upon verification.

3.3 Unauthorized Charges

If you believe you have been charged without authorization, please contact us immediately. Upon investigation and verification, we may issue a refund.

3.4 Service Discontinuation

If we discontinue the Artha ERP Service entirely, we will provide a pro-rated refund for the unused portion of your subscription.

4. Custom Development and Professional Services

Refund policies for custom development services and professional services (implementation, training, customization) are governed by separate service agreements. Generally:

  • A deposit or advance payment for custom development is non-refundable once work has commenced
  • If the project is cancelled before work begins, we may refund the deposit minus a 10% processing fee
  • Refund eligibility and terms will be outlined in the specific service agreement

5. Refund Request Process

5.1 How to Request a Refund

To request a refund under exceptional circumstances:

  1. Contact our support team at support@arthaapp.in
  2. Provide your account details, subscription information, and reason for the refund request
  3. Include any relevant documentation or evidence (e.g., screenshots of technical issues)
  4. Our team will review your request within 5-7 business days

5.2 Management Review

All refund requests are subject to management review and approval. The decision to grant a refund rests solely with Adwaita Techno Labs management and is made at our discretion based on the merits of each individual case.

5.3 Processing Time

If a refund is approved, it will be processed within 7-14 business days. The refund will be credited to the original payment method used for the subscription. Please note that it may take additional time for your bank or payment provider to process the refund.

6. Non-Refundable Items

The following are explicitly non-refundable:

  • Partial subscription periods (you cannot receive a refund for unused days/months)
  • Promotional or discounted subscriptions (unless required by law)
  • Setup fees or one-time charges
  • Data migration or import services
  • Training sessions already conducted
  • Third-party integrations or add-ons

7. Subscription Downgrades

If you downgrade from a higher-tier subscription plan to a lower-tier plan:

  • The downgrade will take effect at the start of your next billing period
  • No refund will be provided for the difference in price for the current billing period
  • You will retain access to your current plan features until the end of the billing period

8. Chargebacks and Disputes

If you file a chargeback or payment dispute with your bank or payment provider without first contacting us to resolve the issue:

  • Your account may be immediately suspended
  • Access to the Service and your data may be restricted
  • We reserve the right to contest the chargeback and provide documentation to your payment provider
  • We encourage you to contact us first to resolve any billing concerns before initiating a chargeback

9. Free Trials and Money-Back Guarantee

If we offer a free trial period or money-back guarantee for certain subscription plans, the specific terms will be clearly communicated at the time of sign-up. These promotional offers may have different refund terms than this standard policy.

10. Changes to This Policy

We reserve the right to modify this Refund and Cancellation Policy at any time. We will notify you of any material changes via email or through a notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated policy.

11. Applicable Law

This Refund and Cancellation Policy is governed by the laws of India. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts in Shivamogga, Karnataka, India.
